1. Legal Basis

This Order is issued pursuant to Section 4 of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 ("the Act") read with Rule 4 of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules, 2013 ("the Rules").

2. Scope

Note: As per Section 4(2)(c) of the Act, at least one member of the IC must be from an NGO or association committed to the cause of women, or a person familiar with the issues relating to sexual harassment. This is a mandatory statutory requirement โ€” an IC without an external member is legally non-compliant.

4. Tenure

The tenure of the IC members shall be three (3) years from the date of this Order, i.e., until [DD/MM/YYYY], unless removed earlier in accordance with the Act.

5. Quorum

The quorum for any IC meeting shall be three (3) members, of whom at least one must be a woman member and one must be the External Member or the Presiding Officer.

6. Functions

The IC shall be responsible for:

  1. Receiving and inquiring into complaints of sexual harassment at the workplace;
  2. Conducting inquiries in accordance with the principles of natural justice and the procedure prescribed under the Act and Rules;
  3. Providing interim relief to complainants as may be appropriate under Section 12 of the Act;
  4. Submitting the Annual Report under Section 21 of the Act to the District Officer;
  5. Organising awareness programmes for employees on the provisions of the Act; and
  6. Performing all other functions assigned under the Act and Rules.

7. Confidentiality

All IC members are bound by the confidentiality obligations under Section 16 of the Act. The identity of the complainant, respondent, and witnesses shall not be disclosed to the public, press, or any other person except for the purpose of implementing the recommendations of the IC.

8. PoSH Policy

This organisation's PoSH Policy ("Prevention of Sexual Harassment Policy"), dated [Date], is read and applied alongside this Constitution Order.
