No. shebox.in is a private legal advisory website operated by Embar Legal Advocates, Mysore. The official Government of India SHe-Box complaint portal is at shebox.nic.in. We are not affiliated with the government in any way.
Does the PoSH Act apply to my organisation?
Yes, if you have 10 or more employees. The PoSH Act 2013 applies to all employers in India — private companies, partnerships, NGOs, government bodies, educational institutions, hospitals, and startups — regardless of sector or nature of business.
What is an External IC Member and why do I need one?
Section 4(2)(c) of the PoSH Act mandates that every Internal Committee include at least one external member — a person from an NGO, association committed to the cause of women, or a legal expert. Failure to include an external member renders your IC legally non-compliant, exposing the employer to fines of up to ₹50,000.
What is the penalty for PoSH non-compliance?
Under Section 26 of the PoSH Act, failure to constitute an IC, failure to file the annual return, or failure to comply with any provision can attract a fine of up to ₹50,000. Repeat offenders face double the fine and possible cancellation of business licence or registration.
